Drug Testing: Frequently Asked Questions

Drug testing in the workplace can increase the safety of the work environment as well as possibly increase the confidence of its employees. According to the National Institute on Drug Abuse, a drug-using employee is 3.6 times more likely to be involved in a work related accident. Drug testing in the workplace may also lead a drug-using employee to treatment. According to the U.S. Department of Labor, 75 percent of drug users over the age of 18 are employed. Drug testing can help a workplace maintain a drug-free and safe environment.

We thought we would take some time to answer some frequently asked questions about drug testing in the workplace.

How is drug testing done?

  • Urine analysis- this is typically the least expensive and most common
  • Blood analysis- this is the most accurate
  • Hair analysis- this is the least invasive

Regardless of the method, drug testing involves following strict guidelines for collection and sending it to a laboratory for testing.

By law, do I have to submit to drug testing?

If you do not wish to submit to drug testing, you don’t have to. It is your right. However, be prepared that the consequences might be similar if you failed the drug testing. By not taking a drug test, an employer may have cause to fire you, or a potential employer may refuse to hire you.

What happens if I fail a drug test?

This depends on your current or future employer’s policy. In some cases, a positive drug test gives legal cause for an employer to fire you or refuse to hire you. These (drug testing laws) differ by city and state. In some cases, an employer may offer assistance in seeking help.

If I fail a drug test, will I be arrested?

Although the laws change by location, it is unlikely. Treatment and rehabilitation is encouraged more often than arrest. However, failing a drug test is NOT the same as being caught carrying or using drugs at the workplace. This action could warrant arrest.
